Terms and Conditions (GTC)
1. Scope
The following General Terms and Conditions (GTC) in the version valid at the time of the order apply exclusively to the business relationship between COCO SHELL and the customer. COCO SHELL does not recognize deviating conditions of the customer and hereby expressly objects to them, unless COCO SHELL has expressly agreed to their validity in writing.
2. Contents of the contract
We offer you the opportunity to order and buy swimwear and accessories via the online shop www.coco-shell.com . A verbal order is not possible. Communication takes place on the COCO SHELL portal in the "Contact" section. The communication is not public. All COCO SHELL offers are non-binding. Our products are mainly manufactured in the Far East. COCO SHELL does not sell products that do not meet the quality requirements of the portal. Slight deviations, color and technical changes compared to the illustrations or descriptions are possible. We assume no responsibility for any changes made to our goods by our manufacturers, as these can be changed at short notice by our suppliers without notice. This applies in particular to colors and the nature of the items. Therefore, all information such as product descriptions, colors and photos on our website are non-binding. We reserve the right to cancel orders at any time, particularly for legitimate reasons such as: payment not received on time, suspected fraud, product out of stock, etc.
3rd order
Your order represents an offer to COCO SHELL to conclude a purchase contract. If you place an order with COCO SHELL, we will send you an e-mail confirming that we have received your order and listing its details (order confirmation). This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. A sales contract is only concluded when we send the ordered product to you and confirm the dispatch to you with a second e-mail (dispatch confirmation).
4. Prices
All prices quoted are in Swiss francs including shipping costs. The price of the goods at the time COCO SHELL receives the order, which is printed on the invoice, is decisive for the invoice amount. Price changes and incorrect price information remain reserved.
5. Terms of Payment
You can use the following payment methods to purchase our products:
Credit card
Payment is made by debiting your credit card. We accept VISA and MasterCard. You enter your credit card data during the ordering process via a secure connection in our online shop and we transmit your data in encrypted form directly to our payment provider. For security reasons, we do not store your credit card details. Your credit card will only be charged once the order process has been completed. The order will be shipped subject to the stated delivery time.
6. Retention of Title
The delivered goods remain the property of COCO SHELL until the invoice amount has been paid in full.
7. Delivery and Shipping Costs
Deliveries are generally only possible within Switzerland. The delivery takes place directly from the COCO SHELL warehouse to the delivery address specified by the customer. The delivery time depends on the product and is between 3 - 20 working days. Delivery is by post and is free of charge. Information about the delivery date are not binding. Exceeding the delivery period does not entitle you to compensation. If COCO SHELL is not able to deliver the ordered goods through no fault of its own, e.g. because a supplier of COCO SHELL does not fulfill its contractual obligations, COCO SHELL is entitled to withdraw from the purchaser. In this case, the customer will be informed that the ordered goods are not available. Any transport damage found must be reported to COCO SHELL immediately upon receipt of the goods.
8. Right of Withdrawal
You can cancel your order within 14 days without giving a reason by returning the goods. The period begins with the receipt of the goods. Timely dispatch of the goods is sufficient to meet the cancellation deadline.

The customer bears the costs for the return. Please note that only sufficiently franked returns will be accepted. The prerequisite for the revocation is that the items are unused, complete and in perfect original packaging. If these requirements are not met, the return of the goods can be refused. The purchase contract is dissolved after the goods have been returned and we will refund payments already made within 14 days of receipt of the goods by bank transfer. Fees for individual payment methods will not be reimbursed.
9. Warranty
The statutory warranty for defects applies unless otherwise stated below. Liability for damage not caused to the products themselves is excluded. This can be indirect and indirect damage and consequential damage such as lost profit, unrealized savings, or damage from delay in delivery. In addition, we are not liable for damage caused by improper storage. We expressly reserve the right to supply the customer with a defect-free replacement in the event of asserted and ascertained defects.
Upon receipt, the customer must inspect the goods immediately for defects and quality. If there is a defect in the purchased item, the customer must contact COCO SHELL immediately, ie within a maximum of 7 days, specifying the defect. All warranty claims after this period have expired are excluded.
10. Responsibility
We take no responsibility for allergic reactions to our products. The material and/or ingredients of the products are declared for each product. Our swimwear should be washed on a "delicate cycle" and should not be put in the tumble dryer, otherwise it could shrink. Liability for incorrectly washed swimwear is expressly excluded.
11. Data Security
We store your order data and treat them as strictly confidential. The relevant data is processed and used for the establishment, implementation and processing of the contracts concluded via the online shop and for the purpose of future customer support and customer care. Credit card data are not stored by us.

12. Final Provisions
Should individual provisions of the contract with the customer, including these General Terms and Conditions, be wholly or partially invalid, or should the agreements contain a loophole, this shall not affect the validity of the remaining provisions. The wholly or partially ineffective provision will be replaced by an effective provision whose economic success comes closest to that of the ineffective provision.
Swiss law applies to all legal transactions with us, excluding the UN Sales Convention (CISG). Place of jurisdiction is Rheinfelden (Canton Aargau).
COCO SHELL expressly reserves the right to adapt these GTC to the circumstances at any time and to apply them immediately.
